基于公路工程结算争议问题分析及解决方案的探讨

近年来，随着基础建设的进一步扩大，高速公路等高等级公路的建设规模也越来越大，在建设实施的实践过程中，因为各种各样的问题引起了一系列成本控制的痛点、难点，同时也在竣工结算时造成很大争议，增加了谈判难度、延缓了项目竣工后结算完成进度。由于公路工程工程量清单没有项目特征描述、使用时需要和中华人民共和国交通运输部颁发的《公路工程标准施工招标文件》（2018年版）第七章 “技术规范”相应章节的施工规范结合起来理解、解释和应用等的特殊性，在个别清单项工程量进行计量时容易产生争议。本文作者通过山东某高速公路实际的工程结算争议案例，通过梳理特别突出的、高频出现的争议点，进行剖析和论证，并结合实际情况给出思路或者解决建议，希望能够在公路工程成本控制和解决结算争议方面提供可参考的解决方案。

Abstract:

In recent years, with the further expansion of infrastructure construction, the construction scale of high-grade highways such as highways has also been increasing. In the practical process of construction implementation, various problems have caused a series of pain points and difficulties in cost control. At the same time, it has also caused great controversy during the completion settlement, increasing the difficulty of negotiations and delaying the progress of settlement after project completion. Due to the lack of project characteristic descriptions in the bill of quantities for highway engineering, and the need to combine them with the construction specifications in Chapter 7 "Technical Specifications" of the "Standard Construction Bidding Document for Highway Engineering" (2018 Edition) issued by the Ministry of Transport of the People's Republic of China, disputes may arise when measuring individual bill items. The author of this article analyzes and demonstrates the prominent and frequently occurring dispute points through an actual engineering settlement dispute case of a highway in Shandong. Based on the actual situation, the author provides ideas or solutions, hoping to provide reference solutions in cost control and settlement disputes of highway engineering.
